[personal profile] icon_uk posting in [community profile] scans_daily
This one really does sort of take the cake in terms of "What?" And I make no apology for sharing it on scans_daily, as I know many of us have enjoyed the work of the artist in question, and commissions in general.

Gisele Lagace (artist on Archie, Jem and the Holograms and others) posted this on her Facebook page yesterday

Welp, no C2E2 for me. Was refused entry at the border. They kept pressing about the comics I had and the sketches, and well, I had to be honest and said that I did get paid for commissions but before hand, but since they weren’t complete, it was considered work in the us. Comics wise, I had maybe $700 in value if I had sold everything. Honestly, it’s not a lot.

Was asked if I was the only one doing this as I looked surprised to be refused entry. I said no, many artists from around the world attend these to promote themselves. I don’t think they cared.

My car was searched and is a mess. And to top it off, I was body searched and finger printed too (they do that when you get refused entry apparently.) It was an awful experience.

Things then went worse when they searched me throughout and found 2 white pills in my wallet. There was no identification on them and I wasn’t sure what they were. Once I calmed down after being touched all over, I remembered they were generic acetaminophen from the dollar store that I carry around in case Marc gets a headache as it sometimes happen. I forgot they were even in there.

Anyway, I wasn’t turned around for the 2 acetaminophen, as they found those after I was refused entry for the comics in my car and the unfinished sketches but they kept us longer there until they were convinced they weren’t narcotics. I never took drugs in my life!

And to think we drove close to 2 days to get there. For nothing. (No, I didn’t get anything from that body search. Maybe Zii would think it’s a good deal.) Anyway… Driving back home.

Now that I’ve been refused entry in the US for this, it’s on file. Don’t expect to see me at a US con until I can figure out a way to get in and being absolutely certain this won’t happen.

This is deeply shameful treatment involving deliberate humiliation. I believe it's technically current laws being enforced, but they have not been to this extent at any time in the past.

If she'd completed the art would they have been able to stop her?

Thank god they stopped it in time, if that material had gotten into the country there could have been a tragedy even worse than the Bowling Green Massacre.

Wait I'm confused....So she got paid for work she hadn't completed yet, and because she'd be finishing it in the US they classified it as her working illegally in the US? That's insane! Man, I love the States but I am really anxious about my trip there in June with the crazy shit that's been coming outta there the past few months :\

Here's the thing I don't get. They were pre-paid commissions. Which means it was a transaction made in Canada, right?

That's also my question, the definition-of-labor thing. I remember we've got one or two lawyers here; maybe they could shed some light on the situation.

Anyway, sympathies for Miss Lagace. Hope this doesn't sour her on stuff.

I kinda remember similar situation from one of those border patrol shows, I think it was actually Canadian border on the Canada's side. The artist there was refused entry because he didn't have work visa, and something about taxes I think. And the sketches and stuff were already finished.

He wasn't treated to bodysearches and all that bullshit because of it though. Just refused entry and told to get a visa next time.

Those border control shows are depressing. I used to watch part of one because it was on before another show I watched, and the schedule was weird...the ridiculous things people were searched or denied entry for were...mind boggling.

(There was one that was kind of amusing, though...guy on a Chinese ship was acting squirrelly when they looked through his cabin, so they tossed it...found a couple hidden DVDs, and had an AHAH! thinking he had kiddie porn. But, no...just regular old movies. Not even pirated. Turned out the captain didn't like them having movies for some reason, and he didn't want to get caught.)

For me the most amusing bit I've seen was in an animal smuggling border watch show (and if you thought the regular ones were depressing then most of that probably isn't for you). Three words. Monkeys in pants.

Seriously? Nobody made this joke yet?

While probably within the confines of the law, I have to say that the behavior of those guards was outrageous.

Truly, truly, truly outrageous.

My friends and I had tickets for the NBA Allstar game last year (hosted by Toronto) and were turned away from the Canadian border. CBSA thought we were a bunch of Rappers, up to no good. Their exact words.

You understand that these were border officers keeping her out of America, right? It doesn't really reflect poorly on Canadians.

She's driving back today, so I haven't spoken back-and-forth with her yet. My reaction is the same as most people here's.

I think joetuss is talking about his own experiences in the other direction, not Giz's.

The point still stands, in both directions - the border guards in both cases are assholes who don't reflect on the regular people in either country.

This is so shameful.

There needs to a complaint and oversight process to review the behavior of and punish border agents who abuse or misuse their power to search, detain and refuse entry.

Right on. Although some commenters on Gisele's Facebook, and on the Bleeding Cool article, are blaming incidents like these on the Trump administration, the problem goes back rather longer than that.

The problem is that immigration officers, on both sides of the U.S./Canadian border, have carte blanche to refuse entry--and to ban further attempts at entry for up to several years--for, in effect, no other reason than "because I say so," and their word is nearly always final. If their departments held them to clear-cut regulations as to what is and isn't legitimate grounds for denying entry and/or banning further entry, rather than leave it up to individual officers' whims, that'd be a big help.

But don't expect that to happen anytime soon; as with police departments, border officers have a vested interest in keeping things the way they are. To be fair, many law enforcement officers (in whichever capacity, in both countries) are reasonable and fair individuals genuinely devoted to the well-being of society. But there are, always have been and likely always will be those whose motivation for going into law enforcement is power over others, power which rarely comes with consequences for its abuse. If we want that to change, our best shot is to put pressure on our legislators to mandate external, civilian oversight of such departments.
