The idea in comic book world that if you try to execute someone and the execution fails then they get release is so bizarre. There is no "time served" for a death sentence.
If the electric chair blows a fuse they just replace the fuse and try again until you are dead.
it's not just a comic book thing though... that's kinda what double jeopardy is. let's say you are electrocuted and you die. the execution is carried out. but then let's say someone injects you with adrenaline and your heart restarts. they wouldn't kill you again.
that said... comics, where people routinely come back to life, SHOULD account for that.

If Wildcat got sentenced to death in real life they would fry him until all his nine lives were used up.
If Superman got death sentenced when he crawls out of the ground months later or whatever, as soon as they confirmed it was the same guy they would inject him with more Kryptonite.
Double jeopardy prevents an accused person from being tried again on the same (or similar) charges and on the same facts, following a valid acquittal or conviction. If someone is sentenced to death and you see them walking around a few days after the execution is carried out you don't need a new trail. All you have to do is show its the same person and then you skip right past all the trial stuff and go right to the execution.
I'm not sure. I mean if the first execution failed, then yes, they try again. But if it succeeded and someone just got up later, I'm not sure the reaction. The justice system is not designed to deal with miracles
However in the Hulk's case? surviving a nuke and the awareness anger makes him stronger they might adjust the sentence for everyone's well being
