Well, if Jason didn't have DNA of fingerprints on record, there might be no proof that he is, in fact, Jason Todd. Alfred or Dick (or even Bruce!Hush, if they can control him) just have to come in, look at him, and say "No, that man is not Jason Todd" ("my brother/son/whatever had black hair." :p) and as far as the police are concerned he's just some guy calling himself Jason Todd.
