I would imagine there's a big difference between what fish think of being inside an aquarium ("Hey, water! Food! Other fish!") and what very likely sapient orcas think about being stolen from their family pods and kept imprisoned to perform in shows.

Plus, most fish in the wild don't exactly live long and comfortable lives, so Aquaman may be judging their accommodations by that standard.

That and the fish accommodations are relatively large comparable to their size. In contrast to that of the orcas.
