Well, in honesty, Lex being a President during Bush era might have to do with it. I am pretty sure Luthor was supposed to be not!George Bush, complete with rigged election (at least sabotaging relief effort to make himself a "better" candidate) or invading Kandorian based on questionable evidence.
And Civil War didn't bode well with the recent controversy over police brutality. Even ignoring "Iron Man killing an unarmed black man and getting away with it", the entire comparison to Registration--which sounds more like accountability law complete with training and insurance--as "slavery" irks me, especially the Cap side sounding less like Freedom Fighter and more like pro-police brutality group.
Broadly speaking, I'm okay with masked autonomous superheroes in fiction but find it to be a terrifying hypothetical IRL.
Still, any reasonable ethical debate goes out the window pretty quickly once the Pro-Reg side were made into full-on super villains.
Apparently Millar has said that he overdid it because he assumed the audience would side with Tony and he wanted to keep things balanced. Between that and Ultimate Captain America, I get the sense that he doesn't think very much of Americans.
