I'm pretty sure Bendis owns the sole rights to Powers the comic, so Cates would just have to get permission from Bendis over a phone call or something to use him.

I’m so used to barely differentiated pastiches with the serial numbers scratched off in stories like this, this threw me for a real loop.

I don't think there have been any pastiches in this so far. But obviously Marvel and DC characters only have the barest hints of an appearance.

That's kind of the draw of this series. Cates has been able to get permission from various people's creator-owned stuff. So Marvel and DC characters just get name mentions, but plenty of Image and indie characters have showed up.
