In all fairness to the New Avengers, they were a little busy between then and Secret Invasion. And Jack's only major interaction with anyone was with Steve, who was suffering a bad case of sort-of dead, so it can sort of be forgiven for no-one knowing about him. (Heck, at this point between here and coming back to die in Spencer's run on Cap - *stops to mutter something* - Jack appeared more in Guardians than he had anywhere else.)
Now, why Iron Man and SHIELD were continuing to use a prison after it had already been the scene of a major break-out is unclear. After all, what sort of idiot keeps using a prison that it's easy to break everyone out of?
