I suppose that since Laura is a "gender-swapped" variant clone of Wolverine she gets around the rule, and Gabby's different claws could be taken as a suggestion that she's similarly a variant on Laura rather than a straight clone.
Really though, I think we're supposed to read the Quiet Council as being obtuse in their refusal to bring back Madelyne Pryor and that they're making up and applying a set of rules to her which no one else has been subject to.

Very disappointed in Scott here. If anyone knows that clones are people too its the Summers family (and Spider-Man). Then again these are the same people that treat Madrox as expendable even though the dupes have unique personalities.

Laura has been confirmed since the relaunch of the X-titles to be Wolverine's daugther, not a really a clone. Which really was the only option that made sense given her origin and appearance. I was frankly relieved I wasn't the only one who thought so and that the writers made the move officially.
Personally I'd be okay with that, considering that her previous do-it-yourselves resurrections haven't undone the deals with demons that turned her into the Goblin Queen.
I feel bad for Madelyne who keeps getting the short end of the stick, but there is already too much Summers drama (and way too many Summers people) in the X-books. So I'm glad the Havok/Maddie thing was cut short and "Hellions" can keep telling stories about an odd team of underexposed characters.
I only have one thing to say - just like Age of X-Man, what a disappointment. They obviously hate both characters. And a sane Madelyne would have proven problematic as hell. You can't have X-Men with Scott as a good guy and Madelyne in the same story.
