The thing is, Owen has spent the entire past year+ of continuity trying to atone for the things he did as a 'temporary' Rogue -- trying to prove he wasn't just a criminal -- trying to redeem and honor the name of Captain Boomerang.
And Johns ignored that. But then, Johns was the one who wrote Owen into becoming a criminal and that was the last time he had written him. And it appears that he really didn't pay attention to how the character had developed since then.
