I'm a little hazy how anyone would think that was a Captain America costume. Unless they are thinking of the Grand Director, who was the 1950s Captain America brainwashed by Dr. Faustus. (Comic books are weird!)

You know what? You are absolutely right. I didn't even question it when I first read the book but you are right. Hell maybe if that waitress hadn't said anything Frank would have just finished eating his breakfast and then treated her that night.

The eagle on the forehead of the cowl is very Heroes Reborn!Cap (Warning for Liefeld art, but not that exact piece you're thinking of).

Bear in mind that this was just after Civil War, where the average American apparently thought that Steve was an anarchist who was trying to keep criminals (ie anti-registration superheroes) from justice.
