I know that Phoenix didn't destroy the Earth. Those aren't the lives I'm talking about.

Unrelated to that point, look at the acid spitting guy's example. He was alive before the Phoenix came. The Phoenix didn't cause him to be born, since he was already born. It just gave him powers. It made him a mutant, yes, but the theme of the X-Men is that it doesn't matter whether you're a mutant or not.

Is that the theme, that it doesn't matter? Wasn't there a big controversy when Havok said not to call him a mutant?

I don't know, they're supposed to be the next step in evolution.

And that's always been a huge problem with the X-Men, as that creates a double standard.

But those lives are not on the x-men's head. They didn't summon the Phoenix.and kick in motion those events. The phoenix was coming the x-men made decisions on how to deal with that. Were they the right decisions well that's up to the reader but they were not responsible for the situation they simply reacted to it.

The inhumans on the other hand are responsible their King did release the gas to intentionally mutate folks so all the folks killed by it are on his head and every time since then the inhumans have made it clear they will not destroy it or let it be destroyed so those deaths are also on them.
